The 500rs. Counterfiet Neckband Resulting 250K Consumer Complaint

500 Rupees might be nothing but the cost of a coffee, a lunch or the price of a book to some students.

How about if it were the cost of a suit? Yes, for a moment it might shock you, especially young lawyers. Young lawyers often complain about not being assigned any work so far.

I Harish Mahour being a legal professional through this blog encourage to my bright young legal colleges like advocates practicing in different district courts, high courts, supreme court and various other judicial or quasi judicial bodies operational today in India. Writing this exciting blog to encourage my young advocate friends to put their 100 percent efforts in the litigation career, and giving a hand to their career achievement I believe to have gained biggest achievement of life.

In the month of March 2024 I used to work as a fresher employee in a corporate insolvency firm at a monthly salary of rupees 15 thousand. I found this job full of efforts and insecure when it comes to a secure career. I observed lawyers badly exploited, so I just decided not to work for any other lawyer from this point of time. However, I had gained the basic practicing skills so far from my previous 4 senior associates for whom I worked with dedication and thats what I found to be sufficient for a better career starter.

At this point of time a day my loved cousin brother came at my home and shared with me that he had purchased a neckband valued approx 500 from renowned ecommerce platform Flipkart. He told that he ordered a Oneplus neckband and received a counterfeit product bearing no branding or product identity.

I just assured my brother to protect his consumer rights. The same day I started to do research on this challenging assignment.

The thorough research on this project gave me an idea to frame a consumer case against the manufacturer, seller, and the ecommerce brand. I faced lots of difficulties not let my team colleagues to help me. As I prefer to work myself initially when It comes about learn new, and thats what every young lawyer is expected.

I drawn a recover complaint for the recovery of rupees 2 lakhs 50 thousand in a district consumer forum of North East Delhi against all the opposite parties. Pleasantly all the opposite parties have been noticed on the first day of hearing about this complaint and 16th Oct is scheduled as the second date of this case.

During the pendency of this consumer complaint I will bright to the light of district consumer court how counterfeit products are being supplied in bulk and how some unknown entities are indulged in unfair trade practices, and how ecommerce platforms to gain extra revenue allow unauthorized companies to food innocent customers. This blog will be updated on every date until this consumer complaint is officially disposed of by the consumer forum and I will share the learnings out of this case.

On 20th July 2024 I filed the above consumer complaint through E-Sarthi portal which renamed from E-dakhil. The next day my complaint was admitted and ordered to submit the physical file. Out of original set two extra copies of complaint were required for court staff and depending on the number of opposite parties remaining sets were attached the court before first day of hearing.

24.07.2024 Is the first day of hearing when I attended the court along with the complainant and introduced the complaint to the hon’ble bench. Judges after carefully going through my case found it to be admissible and directed the opposite for notice of this complaint.
